These Terms and Conditions are governed by the laws of England and Wales. 

2. Legal Status & Licensing 

Embelle Reptiles Ltd is licensed under the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018. 

All animals are bred and sold in accordance with UK animal welfare legislation. 

3. Eligibility to Purchase 

You must be 18 years of age or older to purchase an animal. 

By purchasing, you confirm that: 

You have researched the species. 

You have suitable housing, heating, lighting, and equipment prepared. 

You understand the ongoing financial commitment required. 

You will comply with the Animal Welfare Act 2006. 

We reserve the right to refuse any sale where we reasonably believe the welfare of the animal may be compromised. 

4. Photographs & Representation 

Unless otherwise stated, photographs show the actual animal offered for sale. 

Due to natural development, genetics, environmental factors, shedding cycles, and display differences, we do not guarantee: 

Exact future colouration 

Pattern retention 

Structural development 

Adult size 

Animals are sold as living animals subject to natural change. 

Nothing in this clause affects your statutory rights under the Consumer Rights Act 2015. 

5. Sexing Policy 

Geckos under 15g are sold as unsexed or “possible male/female”. 

Sex cannot be guaranteed under 25g. 

Any indication of sex under this weight is an educated assessment only. 

Mis-sexing of animals under 25g does not constitute a breach of contract unless the animal was expressly sold as guaranteed male or female in writing. 

6. Health Guarantee 

All animals leave our care: 

Feeding independently (unless stated otherwise) 

In outwardly good health 

Free from visible injury or illness 

7-Day Limited Health Guarantee 

The guarantee period begins at: 

Time of collection, or 

Confirmed delivery time (if we arrange courier) 

You must notify us within 24 hours of identifying a health concern. 

If death occurs within 7 days, we may require: 

A written report from a qualified reptile veterinarian 

Photographic evidence 

Evidence of appropriate husbandry setup 

Where a valid claim is accepted, we will provide a remedy in accordance with the Consumer Rights Act 2015. This may include: 

Replacement 

Repair (where applicable) 

Partial or full refund 

We reserve the right to refuse a claim where husbandry standards have not been met. 

This guarantee does not replace or limit your statutory rights. 

7. Exclusions 

The following are not covered where caused after transfer of risk: 

Dehydration 

Impaction 

Burns or overheating 

Injury after collection 

Choking 

Incorrect supplementation 

Inadequate enclosure setup 

Tail loss (dropped tails are a natural defence mechanism and not a defect) 

8. Risk & Delivery 

Collection 

Risk transfers to the buyer upon physical collection. 

Courier Arranged by Us 

Risk transfers upon safe delivery to the agreed address. 

The buyer must be available to accept delivery on the first attempt. 

Courier Arranged by Buyer 

Risk transfers at the point the animal is handed to the courier. 

9. Distance Sales (Online or Remote Purchases) 

Where a sale is conducted at a distance, the Consumer Contracts Regulations 2013 may apply. 

However, the 14-day cooling-off period does not apply once: 

The animal has been delivered, or 

Performance of the contract has begun with your agreement, 

as live animals are classed as perishable goods. 

Deposits remain non-refundable except where required by law. 

10. Payments & Deposits 

Full payment must be received before collection or dispatch. 

A 25% non-refundable deposit is required to reserve an animal. 

Payment plans may be offered at our discretion (maximum 3 months). 

Failure to complete payment within 14 days of the agreed date may result in: 

Cancellation of the sale 

Retention of deposit 

Animal being re-listed for sale 

Deposits are only refundable where required under UK consumer law. 

11. Boarding 

If collection is delayed: 

Weather or courier delays: No charge 

Buyer convenience: £10 per week 

Animals not collected within 30 days of agreed completion date, and without communication, may be treated as abandoned after written notice. 

12. Limitation of Liability 

Nothing in these Terms limits or excludes liability for: 

Death or personal injury caused by negligence 

Fraud or fraudulent misrepresentation 

Any matter which cannot legally be excluded under UK law 

Subject to the above, we are not liable for: 

Indirect or consequential loss 

Loss of breeding potential 

Loss of future earnings 

Speculative value 

Our liability shall not exceed the purchase price of the animal. 

13. Entire Agreement 

These Terms constitute the entire agreement between the parties. 

If any provision is found unenforceable, the remaining provisions remain valid. 

These Terms do not affect your statutory rights.
